Definitions

In this AGREEMENT, unless the context indicates otherwise, the following expressions will bear the following meanings:

1.     “1st Party” Means the Kriss Connect Company.
2.     “2nd Party” Means the Customer.

Terms and Conditions for Rental Agreement

The 2^nd party shall return the subject motor vehicle in the same state/condition as it were when hiring. In case of any loss of the vehicle accessories, the 2^nd party pay an amount equivalent to the costs of the accessories
2.     The 1^st party shall be responsible for servicing and basic maintenance of the subject vehicle.
3.     That the 2^nd party shall promptly notify the 1^st party of expiry of the service to enable the 1^st party to discharge its duty/responsibility of servicing the motor vehicle in time.
4.     That in the event the 2^nd party fails to inform the 1^st party of the expiry of the service and the motor vehicle gets mechanical problems arising out of failure to service, the 2^nd party shall be responsible for the repairs.
5.     That in the event of a flat tyre caused by road hazards in the cause of the lease period, the 2^nd party shall take responsibility for repair.
6.     In the event of any mechanical problem/ failure in the cause of the lease period, the 2^nd party shall promptly inform the 1^st party for purposes of repair.
7.     The subject motor vehicle shall be driven by a duly licensed and competent driver duly authorized by the 2^nd party.
8.     That in case of an accident occasioned by the 2^nd party, driver and/or agent during the lease period not covered by the 1^st party’s insurance cover, then the 2^nd party shall be responsible for bringing the motor vehicle to its original form.
9.     The 2^nd party shall be responsible for fueling.
10.  The 2^nd party shall be responsible for parking tickets.
11.  The 2^nd party shall not sublease the subject vehicle to third parties.
12.  The subject vehicle shall be used for legal operations only and shall be operated in accordance to the laws of the Republic of Kenya.
13.  That any party wishing to terminate this agreement shall give the other party one day written notice or a one day pay in lieu of notice.
